BILLING TERMS AND CONDITIONS

This website is operated by ChubbyTool.com. Throughout the site, the terms “we”, “us” ,"the company" and “our” refer to ChubbyTool.com. ChubbyTool.com offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. Your continued use of this Site constitutes your agreement to these Terms and conditions. If you do not wish to be bound by these Terms and conditions, please do not use this Site.

1.SECTION 1- Definitions

Seller refers to the website owner – the person to whom the order for the purchase has been given.

Buyer refers to the person or organization placing the order.

Goods or services refers to the product(s) for which the buyer has placed an order for with the seller.

2.SECTION 2 - GENERAL

These Terms of Purchase have been executed and delivered by you and constitute a valid and binding agreement between you and the Company, enforceable against you in accordance with their terms. You represent that you are (1) at least 18 years of age, (2) of legal age to form a binding contract, and (3) not a person barred from receiving services under any applicable laws, rules or regulations.

You shall purchase and use the products and services available through the Company Sites, in strict compliance with these Terms of Purchase and all applicable laws, rules and regulations (collectively, “Laws”). You are responsible to comply with all applicable laws with respect to your purchase, including all applicable laws in the jurisdiction to which any products are shipped. All calls, emails and other communications between you and the Company may be recorded.

3.SECTION 3 - PAYMENTS

All payments are due upon completion of order. If a payment is not received or the payment method is declined the order will not be placed for the products and no items will be shipped. The buyer forfeits the ownership of any items due to non-payment. 

Payments to us for Product Fees for your purchase of products must be made using means of payment that we may approve from time to time.We currently require payments be made by PayPal. 

Note: No need to register a PayPal account. PayPal accepts Credit or Debit Card directly now! Free, secure and it protects buyers.

 

4.SECTION 4 - Purchases

You must provide us with your full legal name, an active telephone, a valid credit card and current address to make a transaction through the Network. All payments are processed by PayPal (https://paypal.com) and is subject to additional provisions. We will send you a confirmation email confirming that your request has been processed and that payment was received. In the event we ship item(s) to you we will send a confirmation email to you regarding the same.

4.1 Order Processing
The Company may, in its sole discretion, choose to not process or to cancel your order in certain circumstances. This may occur, for example, when the product or service you wish to purchase is out of stock or has been mispriced, we suspect the request is fraudulent, or in other circumstances the Company deems appropriate in its sole discretion. The Company also reserves the right, in its sole discretion, to take steps to verify your identity to process your order. The Company will either not charge you or refund the charges for orders that we do not process or cancel. Without limiting the foregoing, the Company reserves the right to: (i) revoke any stated offer; (ii) correct any errors, inaccuracies, or omission; and (iii) make changes to prices, content, promotion offers, product descriptions or specifications, or other information without obligation to issue any notice of such changes (including after an order has been submitted, acknowledged, shipped, or received, except as prohibited by law).

5.SECTION 5 - Products and Pricing.

5.1 Product and Service Descriptions

The Company attempts to provide accurate descriptions of products and services on the Company Sites. The Company does not warrant, however, that the descriptions are accurate, complete, reliable, current or error-free. If a product or service offered on the Company Sites is not as described, your sole remedy is to return the item, as specified in these Terms of Purchase.

The Company Sites may offer a quick view type feature for various products. This feature allows you to view price information about the product and add the product to your cart without opening the product page. The quick view feature and this "add to cart" feature are offered for your convenience only. The product page is where you will find more detailed information about a product, its source, features and pricing.

5.2 Pricing Information

The Company strives to provide accurate pricing information regarding the products and services available on the Company Sites. We cannot, however, insure against pricing errors. The Company reserves the right, at its sole discretion, to not process or to cancel any orders placed for a product or service whose price was incorrectly posted on the site as a result of an error. If this occurs, the Company will notify you by email. In addition, the Company reserves the right, at its sole discretion, to correct any error in the stated full retail price.

5.3 Product and Service Availability

The Company Sites may contain information regarding the availability of merchandise. This information can be used to estimate the likelihood that an item will be shipped immediately after you place your order. Estimated delivery date to your destination address of an item will be around 30 days or less after your successful payment, it is subject to change based on shortage of an item, bad weather, transit time of your carrier, destination address etc. Unfortunately, the Company cannot guarantee that an item listed as “in stock” will actually ship right away, as inventory can change significantly from day-to-day. In rare cases, a product or service offering may be in stock when a customer places the order, and sold out by the time the Company attempts to process the order. Should this happen, the Company will notify you by email. Service offerings that are out-of-stock generally are no longer available. If Company determines that a product or service you wish to purchase is no longer available, the item will be cancelled from your order. The Company will notify you by email and delete the item from the Company Sites.

6.SECTION 6 - Specific Additional Disclaimers and Obligations

In addition to the general disclaimers in the Terms of Use for products and services purchased through the Site, products and services purchased on the Site: (a) may not include any manufacturer warranties, even if a certain product or service is available elsewhere with one; (b) may not include any service or support options; (c) may not have product manuals, instructions or safety warnings in your native language or in some destination country languages; (d) may not be designed in accordance with your jurisdiction’s standards, specifications, and labeling requirements; and (e) may not conform to your jurisdiction’s voltage and other electrical standards (which may require the use of an adapter or converter). It is your responsibility to, and you hereby agree to, research the product to ensure it meets your needs and that it can be lawfully imported into your jurisdiction.

7.SECTION 7 - Taxes
You are responsible for any taxes, customs duties and fees levied by the jurisdiction to which the products are shipped, including but not limited to any sales or use tax, value added taxes or tariffs.

8.SECTION 8 - Shipping Policies

We provide free shipping on All orders above US$48, if below US$48, the flat shipping fee is $4.98. If an item is lost during shipping, the seller will reship a item to the buyer. If an item is damaged during shipping, seller will not be held responsible. The seller will take all reasonable steps to ensure the protection from loss, damage or destruction of the services or materials it supplies the buyer.

 

9.SECTION 9 - Refund/Return Policy

Items are entitled to be refunded or returned if the buyer notifies the seller within 14 days of the date of purchase. The buyer must contact the seller by email:chubbychunk1@gmail.com or through the customer account page on the website where a return can be processed. Shipping charges incurred for returned merchandise is the responsibility of the buyer.

 

10.SECTION 10 - Cancellation

The buyer must cancel your order within 12 hours after creating it for the cancellation to be applied. If the item has already shipped, We will not be able to cancel the order. All you need to do is send us an email with the subject line "CANCEL". Please email chubbychunk1@gmail.com

11.SECTION 11 - Complaints

Any complaints about items or the seller should be submitted to our support team. Please email: chubbychunk1@gmail.com. There is no guarantee of a resolution. Each case will be looked at individually and the seller will be in contact.

12.SECTION 12 - Legalities

The seller is not responsible for any health or safety concerns once the buyer has received the goods or services. If any harm is incurred from the items purchased by the buyer, the seller shares no responsibility.

Any dispute arising out of such use of the website is subject to the laws of the site owner's state.
